The purpose of these "general terms and conditions of use" is to provide a legal framework for the terms and conditions under which Invyo services are made available to users.
Invyo services are open to all individuals.
The general conditions of use must be accepted by any user wishing to access the site. They constitute the contract between the site and the user. Access to the site by the user signifies acceptance of these terms and conditions.
In the event of non-acceptance of the general conditions of use stipulated in the present contract, the User must renounce access to the services offered by the Invyo site. Invyo reserves the right to unilaterally modify the content of the present general conditions of use at any time.
This website is normally accessible to users at all times. However, Invyo may decide to interrupt the site for technical maintenance purposes, in which case Invyo will endeavour to inform users of the dates and times of the intervention in advance. The Invyo website is updated regularly. In the same way, the legal notices may be modified at any time: they are nevertheless binding on the user, who is invited to refer to them as often as possible in order to take cognizance of them.

The Invyo website is hosted by OVHcloud, whose head office is located at 2 rue Kellermann, 59100 Roubaix- FRANCE.
The purpose of this clause is to define the various essential terms of the contract:
Site: the https://Invyo.io/ website (the main site), the corresponding mobile applications and any derivative sites published by Invyo.
User(s) and/or "You ": any visitor to the site and any user who has entered personal data in the site's registration form(s) in order to benefit from all or part of the services, as provided on the site, and who has accepted our terms of use and this privacy policy.
Controller: means the natural or legal person, public authority, agency or any other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by the law of the Union or of the Member States, the controller or the specific criteria for his designation may be provided for by the law of the Union or of the Member States.
Cookies: generally refers to tracers used alternatively or in combination, in particular to facilitate the User's browsing experience, to offer services tailored to the User's interests (advertising cookies), to enable statistics to be compiled (audience cookies) and to enable the User to access personalized products and services on the Site.
GDPR: means the General Data Protection Regulation No. 2016/679 of April 27, 2016 applicable as of May 25, 2018 or, in lieu thereof, any Law that may be adopted to transpose said Regulation.
Personal data: any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Personal data includes bank details.
The purpose of the Invyo.io site is to sell computer programs/software for the collection, enhancement, promotion and analysis of data for the benefit of companies and financial institutions.
Invyo.io strives to provide information that is as accurate as possible. However, Invyo.io cannot be held responsible for any omissions, inaccuracies or failure to update information, whether caused by Invyo.io or by third-party partners supplying such information.
All information provided on the Invyo.io website is given for information only, and is subject to change. Furthermore, the information on the Invyo.io website is not exhaustive. It is subject to modifications having been made since it was put online.
The Invyo.io website cannot be held responsible for any material damage linked to the use of the site. In addition, the user of the site undertakes to access the site using recent, virus-free equipment and with an up-to-date browser. The Invyo.io website is hosted by a service provider in the territory of the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679).
The aim is to provide a service that ensures the best possible level of accessibility. The host ensures continuity of service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible time, in particular for maintenance purposes, to improve its infrastructures, in the event of infrastructure failure or if the Services generate traffic deemed abnormal. Invyo.io and the host cannot be held responsible in the event of malfunction of the Internet network, telephone lines or computer and telephony equipment, in particular due to network congestion preventing access to the server.
The site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at the User's expense.

Trademarks, logos, signs and any other content on the site are protected by the French Intellectual Property Code, and more specifically by copyright.
The User requests prior authorization from the site for any reproduction, publication or copy of the various contents.
The User undertakes to use the contents of the site in a strictly private context. Use of the contents for commercial purposes is strictly forbidden.
Any content put online by the User is his/her sole responsibility. The User undertakes not to put any content online that could harm the interests of third parties. Any legal action taken by a third party against the site will be borne by the User.
User Content may be deleted or modified by the Site at any time and for any reason. The User does not receive any justification or notification prior to the deletion or modification of User Content.
7.1 Persons responsible for the collection of personal data
The information requested when registering on the site is necessary and obligatory for the creation of the User's account. In particular, the e-mail address and telephone number may be used by the site for the administration, management and animation of the service.
The site ensures that the User's personal information is collected and processed with due respect for privacy, in accordance with the French Data Protection Act no. 78-17 of January 6, 1978.
For Personal Data collected in the context of product pricing or site browsing, the party responsible for processing Personal Data is Invyo, represented by Alexandre VELLUTI(alexandre@invyo.io), its legal representative. In accordance with articles 39 and 40 of the law dated January 6, 1978, the User has the right to access, rectify, delete and object to his/her personal data. The User may exercise this right by post to Service Technique - Invyo, 10 Rue de Penthièvre, 75008, Paris; or by e-mail to hello@invyo.io.
As the party responsible for processing the data it collects, Invyo.io undertakes to comply with the legal provisions in force. In particular, it is its responsibility to establish the purposes of its data processing, to provide its prospects and customers with complete information on the processing of their personal data once their consent has been collected, and to maintain an accurate register of processing. Whenever Invyo.io processes Personal Data, Invyo.io takes all reasonable steps to ensure that the Personal Data is accurate and relevant to the purposes for which Invyo.io processes it.
7.2 Purpose of the Data Collected

Invyo.io does not sell your personal data, which is only used for statistical and analysis purposes.
7.3 Right of access, rectification and opposition
In accordance with current European regulations, Invyo.io users have the following rights:
As soon as Invyo.io becomes aware of the death of a User and in the absence of instructions from the User, Invyo.io undertakes to destroy the User's data, unless its retention is necessary for evidentiary purposes or to meet a legal obligation.
If the User wishes to know how Invyo.io uses his Personal Data, ask for them to be rectified or object to their processing, the User may contact Invyo.io in writing at the following address:

In this case, the User must indicate the Personal Data that he would like Invyo.io to correct, update or delete, identifying himself precisely with a copy of an identity document (identity card or passport).
Requests for deletion of Personal Data will be subject to the obligations imposed on Invyo.io by law, in particular as regards the retention or archiving of documents. Finally, Invyo.io Users may lodge a complaint with the supervisory authorities, in particular the CNIL.
7.4 Non-disclosure of Personal Data
Invyo.io refrains from processing, hosting or transferring Information collected about its Customers to a country outside the European Union or recognized as "not adequate" by the European Commission without informing the Customer in advance. For all that, Invyo.io remains free to choose its technical and commercial subcontractors on condition that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulation (RGPD: n° 2016-679).
Invyo.io undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorized persons. However, if an incident affecting the integrity or confidentiality of the Customer's Information is brought to Invyo.io's attention, Invyo.io must inform the Customer as soon as possible and inform the Customer of the corrective measures taken. Invyo.io does not collect any "sensitive data".
The User's Personal Data may be processed by Invyo.io subsidiaries and subcontractors (service providers), exclusively in order to achieve the purposes of this policy.
Within the limits of their respective responsibilities and for the purposes mentioned above, the main persons likely to have access to Invyo.io User data are mainly our customer service agents.
The sources of the information published on the site are deemed reliable. However, the site reserves the right not to guarantee the reliability of the sources. The information provided on the site is for information purposes only. The User therefore assumes sole responsibility for use of the information and content on this site.
The User is responsible for keeping his/her password secret. Any disclosure of the password, in whatever form, is forbidden.
The User assumes all risks associated with the use of his/her login and password. The site declines all responsibility.
Any use of the service by the User resulting directly or indirectly in damage must be compensated by the site.
The site cannot guarantee the security and confidentiality of data transmitted. However, the site undertakes to use all necessary means to guarantee data security and confidentiality to the best of its ability.
The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
Invyo.io cannot be held responsible for any updates or changes to the Site program that may result in the Site being temporarily unavailable and/or out of date.
Likewise, Invyo.io reserves the right to interrupt or suspend one or more functionalities offered on the Site, at any time and without notice, without having to justify its decision. In this case, Invyo.io shall not be held liable in any way whatsoever and Users shall not be entitled to claim any compensation of any kind.
Invyo.io may offer Users access to third-party sites or participation in loyalty programs, marketing or any other activities taking place on a third-party web site or program. In this case, Invyo.io cannot be held responsible for the activities of these third parties and urges its visitors to read the Terms and Conditions of the proposed participation. In particular, third-party sites visited by the User or advertisements appearing on the Site may contain "cookies" (cookies are small texts sent by a web site to your browser and stored on your computer). These are managed by third parties independent of Invyo.io under their sole responsibility, it being specified that Invyo.io has no access to the data that may be obtained by means of these "cookies".
Invyo.io is under no legal obligation to monitor any content transmitted or stored via the Site.
A "cookie" is a small data file sent to the User's browser and stored on the User's terminal (e.g. computer, smartphone), (hereinafter "Cookies"). This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system, and the date and time of access. Cookies are in no way likely to damage the User's terminal.
Invyo.io may process information about the User's visit to the Site, such as pages consulted and searches performed. This information enables Invyo.io to improve the content of the Site and the User's browsing experience.
As Cookies facilitate browsing and/or the provision of services offered by the Site, the User may configure his/her browser to allow him/her to decide whether or not to accept them, so that Cookies are stored in the terminal or, on the contrary, are rejected, either systematically, or depending on the sender. The User may also configure his/her browser software so that acceptance or rejection of Cookies is proposed from time to time, before a Cookie is likely to be recorded in his/her terminal. Invyo.io informs the User that, in this case, it is possible that not all functions of his browser software will be available.
If the User refuses to accept cookies on his or her terminal or browser, or if the User deletes cookies stored on his or her terminal or browser, the User may be informed that his or her browsing and experience on the Site may be limited. This may also be the case when Invyo.io or one of its service providers cannot recognize, for technical compatibility purposes, the type of browser used by the terminal, the language and display settings or the country from which the terminal appears to be connected to the Internet.
Where applicable, Invyo.io declines all responsibility for the consequences linked to the degraded functioning of the Site and any services offered by Invyo.io, resulting from (i) the refusal of Cookies by the User (ii) the impossibility for Invyo.io to record or consult the Cookies necessary for their functioning due to the User's choice. To manage Cookies and User choices, the configuration of each browser is different. It is described in the browser's help menu, which will show how the User can modify his or her wishes with regard to Cookies.
At any time, the User may choose to express and modify his or her wishes with regard to Cookies. Invyo.io may also use the services of external service providers to help it collect and process the information described in this section.
These types of cookies are deposited on your terminals only if you consent to them, by continuing your navigation on the Invyo.io website or mobile application. The User may, however, revoke his or her consent to Invyo.io depositing this type of cookie at any time.
10.1. Internet tags
Invyo.io may occasionally employ web beacons (also known as tags, action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics partner that may be located (and therefore store related information, including the User's IP address) in a foreign country.
These beacons are placed both in online advertisements enabling Internet users to access the Site, and on its various pages.
This technology allows Invyo.io to evaluate visitors' responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information consulted), as well as the use of this Site by the User.
The third-party service provider may collect information about visitors to the Site and other Web sites using these tags, compile reports on Site activity for Invyo.io, and provide other services relating to the use of the Site and the Internet.
The duration of the present contract is indefinite. The contract takes effect with regard to the User from the time of use of the service.
This contract is governed by French law. In the event of failure to reach an amicable settlement of a dispute between the parties, the courts of the Paris Court of Appeal shall have sole jurisdiction.
